Order modified, by adding to the decretal paragraph thereof, after the words: "Motions to dismiss are denied", the following: "except as to the second cause of action asserted in the third-party complaint, which cause of action is dismissed for failure to state a cause of action." As so modified, order affirmed insofar as appealed from, without costs or disbursements.

Third-party plaintiff is directed to serve all prior pleadings in the main actions not already served...
