Plaintiff-appellee sued defendant-appellant alleging that defendant placed an unauthorized mortgage against the property of plaintiff in order to obtain funds for personal use. Plaintiff asked that the mortgage be removed and for judgment against the defendant for amounts paid by plaintiff and which would have to be paid by plaintiff as a result of the alleged unauthorized mortgage.
