M.D. O'HARA, J.

Appellant was charged with armed robbery. MCLA 750.529; MSA 28.797. Together with his attorney he appeared at trial level on the appointed day. A plea to the lesser included offense of assault with intent to rob being armed, MCLA 750.89; MSA 28.284, was offered and accepted. Defendant was then duly sentenced to 10 to 20 years. The sentence is within the legislatively prescribed limits.
