Defendant, Ruthe Carbona, appeals from a denial of her motion for a new trial based on newly discovered evidence. After a jury trial, defendant was convicted of murdering her husband and sentenced to a term of 20 to 60 years. On direct appeal, the conviction was affirmed by this court in People v.
