James R. Randolph, defendant and appellant herein, was charged in the District Court for Otoe County with embezzlement under section 28-538, R.R.S.1943. On December 3, 1976, defendant pled guilty to the charge, and was subsequently sentenced to confinement in the penal complex for a period of not less than 2 nor more than 5 years.
