These two cases were tried together: the resolution of the first is dispositive of the second. On December 3, 1969, the defendant, William J. Zehrung, director of health for the town of New Milford, approved the layouts for an apartment complex of 460 family units with plans for a subsurface disposal system and issued the necessary permits as required by the state's health code. On December 10, 1969, Zehrung revoked those permits whereupon the plaintiff...
