SANDERS, Chief Justice.

In 1971, a grand jury indicted the defendant, Billy Taylor, for aggravated kidnapping, a violation of LSA-R.S. 14:44. A jury found the defendant guilty, and the court imposed the death penalty. This Court affirmed the conviction, but remanded with instructions to sentence him to life imprisonment. La., 282 So.2d 491 (1973). The United States Supreme Court reversed.1
