DIXON, Justice.

On July 8, 1976 Frank J. Lain was charged by bill of information with possession of marijuana with intent to distribute in violation of R.S. 40:966(A)(1) and (B)(2). Defendant pleaded not guilty and filed a motion to suppress the marijuana seized on the date of his arrest. He argued that the search was conducted without probable cause and was a warrantless search not justified by any recognized exception...
