MARTIN, Judge.

The defendant argues, in his first assignment of error, that the trial court erred in denying his motion to continue the case based on the absence of blacks in the jury pool. He contends that, by denying his motion, the court either abused its discretion or violated his constitutional right to a fair and impartial trial by a jury of his peers. We disagree.
