MEMORANDUM OPINION AND ORDER

CROWLEY, District Judge.

Defendant has been indicted1 for a violation of Title IV of the Omnibus Crime Control and Safe Streets Act of 1968, 18 U.S.C. § 922(h).2 In pertinent part, that statute provides:

(h) It shall be unlawful for any person— (1) who is under indictment for, or who has been convicted...
