This is a direct appeal in a criminal action in which defendant-appellant, Ronald G. Shaffer, was convicted after a trial by jury of first degree murder (K.S.A. 21-3401), aggravated robbery (K.S.A. 21-3427), and unlawful possession of a firearm (K.S.A. 21-4204[1][b]).

The evidence reveals that at approximately 7:30 A.M. on February 29, 1976, a customer of the Louk Oil Station in Topeka...
