On September 10, 1975 Judge THADDEUS PIUSIENSKI of the Village of Depew Court issued a search warrant for premises occupied by defendant Potwora and for the search of a certain van truck located on or near the premises. The affidavits supporting the application for a warrrant stated that a Rochester Judge had reviewed a number of the publications found in the defendant's premises and had declared them to be obscene.
