In 1964 the appellant was indicted by a grand jury of Marion County for first degree murder. The victim was a police officer for the City of Hackleburg, Alabama. A trial in November of 1964 resulted in a mistrial. The following year the appellant was retried and found guilty. Punishment was fixed by the jury at life imprisonment.
