JORDAN, Justice.

Appellant was charged with felony murder in the death of Charles Bohannon, Jr., a two-year-old child. The indictment alleged that appellant, while in the commission of a felony, i.e., cruelty to children, caused the death of the infant by beating him with his hands. A jury found him guilty as charged and also found that the murder was "outrageously and wantonly vile" but did not recommend the death penalty. Appellant was sentenced to life imprisonment...
