Plaintiff is a River Rouge schoolteacher. He was suspended by the board of education for unprofessional conduct. This ruling was reversed by the State Teacher Tenure Commission, which ordered that plaintiff be reinstated with back pay. It did so because of what they viewed as noncompliance with MCLA 38.104(e); MSA 15.2004(e), which reads as follows:
