In the late evening of July 12, 1966, plaintiff was assaulted and injured. At approximately 2:30 a.m. of July 13, 1966, he was admitted to defendant hospital. Plaintiff was diagnosed as having a broken jaw. Ten days after his admittance to the hospital, plaintiff was operated upon by Dr. Newby, a plastic surgeon.
