Appellant, Athlyn B. Waller, was a middle-level merit employee of Appellee, Montgomery County, Maryland. On 4 April 1975, the County demoted Waller, for reasons which are not material to this case. He objected to this demotion by instituting a timely appeal to the County Personnel Board. Later, in October, a virtually automatic salary increment was withheld by action of his department head.
