Defendant William Ernest Hamm appeals the order of acting St. Clair Circuit Judge James S. Thorburn entered December 18, 1975, granting a mistrial in defendant's prosecution for first-degree murder, contrary to MCLA 750.316; MSA 28.548, and assault with intent to murder, contrary to MCLA 750.83; MSA 28.278.
