TYSON, Presiding Judge.

Elton Hall was charged by indictment with "escapes or attempts to escape from the penitentiary" pursuant to Title 14, § 153, Code of Alabama 1940. The jury found the appellant guilty as charged, and the trial court set punishment at twenty years in the penitentiary.
