"1. The Court erred in finding and determining that the Court of Common Pleas of Portage County, Ohio is not an agency and instrumentality of the State of Ohio within the meaning of R. C. 2743.01(A), and was in error in determining that the Court of Common Pleas of Portage County, Ohio is a political subdivision...
