Appellant, Barry Daniel Decker, was residing in Room 33 at the Pine Hotel in Flagstaff, Arizona, on January 19, 1976. Police officer Sewell responded to a report of a prowler at the hotel at approximately 7:30 p.m. that evening and entered the building in furtherance of his investigation.
