OPINION

ALLPORT, J.

Plaintiff appeals from a judgment dismissing his action for injunctive relief (reinstatement to track privileges)1 and damages2 against Hollywood Park Race Track. The judgment of dismissal is predicated solely upon a finding by the trial court that plaintiff failed to exhaust his available administrative remedies before filing his action at law.
