On January 19, 1970, the defendant was indicted by a grand jury for the crime of murder in the first degree. On a trial to a jury, the defendant was found guilty of the crime of the lesser included offense of murder in the second degree and the court, after denying the defendant's motion to set aside the verdict, sentenced the defendant to life imprisonment.
