HATHAWAY, Judge.

The real party in interest is the defendant in a pending Pima County Superior Court criminal case. He is charged with first degree murder and two counts of assault with a deadly weapon. The murder charge is based on the death of a fourteen year old junior high school student. The defenses disclosed to the state were self-defense, intoxication, and insanity.
