On May 9, 1976, officers of the Tucson Police Department received a report of two juveniles trying to push a safe away from the area of the Disabled American Veteran's Thrift Store. Appellant was arrested at the scene along with two juveniles and was indicted on one count of conspiracy to commit burglary and one count of grand theft.
