Following an appeal by defendant from the report and award of the arbitrators, this matter has come before us on plaintiff's motion for summary judgment, defendant's answer thereto, and plaintiff's reply. Since there exists no issue as to the facts, but only a question of statutory interpretation, the motion is ripe for decision.
