The appellant, William Muscatello, was indicted by the Grand Jury of Cuyahoga County for aggravated murder in violation of R. C. 2903.01 on February 13, 1975. The indictment charged that the appellant, on or about February 2, 1975, unlawfully and purposely and with prior calculation and design, caused the death of Richard Rauscher.
