The People appeal from the trial court's dismissal of their action before the defendant had been placed in jeopardy. (Pen. Code, § 1238, subd. (a)(8).) The dismissal was made following the granting of a Murgia motion by defendant, Barbara Ruth Garner. (See Murgia v. Municipal Court, 15 Cal.3d 286
