After a jury trial appellant was convicted of sale of heroin (Health & Saf. Code, § 11352) and was sentenced to state prison.

In March 1975, Debra Foster, who had used heroin in the past in appellant's presence, acted for the San Luis Obispo Sheriff's office as an undercover purchaser of heroin from appellant, in return for the dropping of forgery charges...
