This case is before the court en banc on defendant's motions in arrest of judgment and for new trial following his conviction for manufacture of marijuana, a controlled substance.

The sole issue in the case is whether the mere growing of marijuana constitutes manufacture as a matter of law under the provisions of The Controlled Substance, Drug, Device and Cosmetic Act of April 14, 1972, P.L. 233, 35 P.S. § 780...
