PER CURIAM.

On October 31, 1975, defendant was convicted of assault with intent to do great bodily harm less than murder1 following a jury trial in Bay County Circuit Court. He was sentenced on November 24, 1975, to a prison term of 3 to 10 years and now appeals.

At 9 p.m. on September 2, 1975, defendant, James Baker, Florence Turner and others began drinking alcoholic beverages at defendant's house on Grant Street in Bay City...
