The defendant, Robert McKinley, and co-defendants, Frank Kostrzeski and Robert Tobel, were convicted of criminal damage to property exceeding $150 in a joint bench trial in the circuit court of McHenry County. McKinley was sentenced to a term of 1 year to 1 year and a day in prison. The Appellate Court for the Second District affirmed (42 Ill.App.3d 48
