JAMES, J.

Defendant George Warren Williams was charged with two counts of possessing the drug Ritalin in violation of the Uniform Controlled Substances Act. At the hearing on his motion to suppress evidence, the trial judge ruled that Ritalin found on Williams' person was seized unlawfully. The charges were dismissed. The State appeals as authorized by CAROA 14(8)(5).1
