On May 28, 1970, plaintiff, then just short of 16 years old, was very seriously injured when he dove into a swimming pool manufactured by defendant Anthony Pools, Inc. On April 13, 1972, plaintiff started this suit for damages, claiming that the proximate cause of his permanent injuries was negligent design of the pool and breach of the implied warranty of fitness for the purpose intended.
