Appellant commenced an action against Tom Althauser Realty, Inc., a real estate broker, and Hal Barnes, a real estate salesman, alleging that he paid them $7,500 as a deposit on the purchase of real estate and that they failed to return his deposit when the real estate transaction was not completed due to no breach of contract on his part. Althauser Realty, Inc., answered denying all the essential allegations of the complaint. Service was not obtained...
