Plaintiff filed a declaration against the defendants Joe Mosby, Jr., Joe Mosby, Sr. and Mosby Packing Co., Inc., on October 8, 1976. The declaration was in two counts and in the first count plaintiff charged that he lawfully entered the place of business operated by defendants on September 24, 1976 and while there was "accused of having stolen meat and other things."
