BUSSEY, Presiding Judge:

The appellant, Charles Allen, hereinafter referred to as defendant, was charged, tried before a jury, and convicted in the District Court, Sequoyah County, Case No. CRF-75-13, of the crime of Second Degree Arson, in violation of 21 O.S. 1971, § 1402. The jury fixed his punishment at five (5) years in the custody and control of the Department of Corrections of the State of Oklahoma...
