Patricia Fugitt originally brought this suit as a class action under Section 1 of the Civil Rights Act of 1871, 42 U.S.C.A. § 1983 (1974).1 She withdrew all of her class action claims and her request for injunctive relief at the pre-trial conference and now seeks only damages.
