Plaintiff appeals from a judgment dismissing her complaint for failure to file the 90-day notice provided for in § 24-10-109(1), C.R.S.1973. We affirm in part and reverse in part.

The essential facts, for purposes of this appeal, are not in dispute. On May 22, 1975, plaintiff's car was struck from the rear by another car that had been rear-ended by a bus owned by defendant Regional Transportation...
