GALLAGHER, Associate Judge:

This is an appeal by the government under D.C.Code 1973, § 23-104(a)(1) on the trial court's grant of defendant's motion to suppress evidence. As a result of inquiries by the court during oral argument, the government subsequently requested, and was granted, leave to file a post-argument supplemental memorandum directed to the subject matter of the court's inquiries.1
