In September, 1974, the defendant was found guilty of possession of over one-half ounce of cannabis in violation of C.R.S. 1963, 48-5-2. He was sentenced to five to eight years in the State Penitentiary for this felony conviction. The state legislature subsequently changed the crime of possession of less than one ounce of cannabis to a petty offense and reduced the penalty to a $100 fine.
