This is a suit filed by Frank Arender, a real estate broker, to enforce the bonus clause of a 30-day "exclusive listing agreement" between him and defendant, Jess Carr Gilbert. The exclusive listing agreement provided that plaintiff would receive a commission of $35,000 plus a bonus of one-half of any amounts received in excess of the price set by Gilbert for the sale of certain woodland and timber on the "Black Hawk Plantation".
