This is a suit for workmen's compensation death benefits. Mrs. Charles Kinchen Lushute, widow of Charles Vincent Lushute and his sole dependent, brought this action on May 21, 1975 against Frank J. Diesi, as operator of the Little Capitol Restaurant.
