The appellant (Jarman) was charged with the offenses of drawing a deadly weapon and assault with intent to kill. A jury found him guilty of drawing a deadly weapon and of assault, a lesser offense included in the charged offense of assault with intent to kill. The trial court ruled that the evidence did not support the conviction for drawing a deadly weapon and ordered Jarman discharged as to that offense...
