This case is a criminal prosecution for burglary and battery. The defendant was convicted as charged and appeals.

The only substantial issue involved in this appeal is whether it is a burglary for a husband who is physically separated from his wife to enter upon premises possessed by his wife without the wife's consent with intent to commit an offense therein.
