This appeal arises out of a tort action for personal injury damages. Charley W. Smith, defendant-appellee, used a shotgun and shot and injured Patsy Brown and John Ray Ogden. A companion suit was filed by Patsy Brown (now Ogden) and the two suits were consolidated for trial and appeal. We are rendering judgment in the companion case on this date. See Patsy Brown v.
