BUSSEY, Presiding Judge:

Appellants, Edward Hutchinson and his wife Pamela Jean Hutchinson were charged and jointly tried and convicted in the District Court, Le Flore County, for the offense of Unlawful Possession of Marijuana, Case Nos. CRM-76-133, and CRM-76-134, in violation of 63 O.S.Supp. 1973, § 2-402(B)(2). The jury fixed the punishment of both defendants at one (1) year in the County Jail....
