BUSSEY, Presiding Judge:

The Appellant, Charles Bettlyoun, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Pottawatomie County, Case No. CRF-76-94, for the offense of Assault with a Dangerous Weapon, in violation of 21 O.S. 1971, § 645. After a trial by jury and on the 22nd day of September, 1976, the defendant was sentenced to a term of three (3) years...
