In July, 1975, Forest Statham, our Respondent, sued South Texas Independent Milk Producers Association (STIMPA), and its employee, Anastacio Hinojosa, for damages in the sum of $300,000.00. Statham alleged that his damages were caused by the negligence of Hinojosa when the STIMPA truck he was driving struck Statham's pickup from the rear on March 10, 1975, while he was stopped with other traffic at a highway construction site.
