The defendant was charged with attempt murder and pursuant to plea negotiations pleaded guilty to the reduced charge of aggravated battery on January 22, 1976. The plea negotiations did not include the sentence. On February 18, 1976, the defendant was sentenced to a term of 1-4½ years imprisonment.
